Terms of Service

1. Acceptance of Terms

By accessing or using Voice Capture ("Service"), operated by Insight Genius LLC, a company registered in Delaware, USA ("Insight Genius LLC", "we", "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Description of Service

Voice Capture is a SaaS platform that provides embeddable voice capture widgets for online surveys. The Service transcribes audio responses using AI and provides dashboards for analysis and export.

3. Account Registration

• You must provide a valid email address and create a secure password
• You are responsible for all activity under your account
• You must be at least 16 years old to use the Service
• One person or entity per account (no shared credentials)

4. Plans and Pricing

The Service offers the following credit packs:

1 credit = 1 transcribed response. Credits do not expire.

Prices are in USD. Credit packs are purchased as one-time payments — there are no subscriptions, no auto-renewal, and nothing to cancel.

5. Payment and Billing

• Payments are processed securely by Stripe. We do not store credit card numbers.
• Credit packs are one-time purchases. There is no recurring billing or auto-renewal.
• Credits are added to your account balance immediately after successful payment.
• Credits do not expire and are non-refundable once added to your account.
• Refunds are handled on a case-by-case basis for purchases within 14 days where no credits have been used.
• Paid plans and credits are billed as described at checkout and processed securely by our payment providers. Purchases of digital services and prepaid credits are non-refundable once the transaction is complete, as they grant immediate access to a digital service, except for unused credits or balance within any statutory consumer-withdrawal period required by applicable local law (for example, 7 days in Brazil and equivalent periods in Mexico or the EU).

6. Acceptable Use

You agree NOT to:

• Use the Service for illegal purposes
• Collect audio without consent of respondents
• Attempt to circumvent plan limits or abuse the API
• Reverse engineer the widget or API
• Upload malicious content or exploit security vulnerabilities
• Resell access to the Service without authorization

7. Your Data

• You retain ownership of all data you upload or generate through the Service
• You grant us a limited license to process your data solely to provide the Service
• You are responsible for obtaining consent from survey respondents
• We will not access your data except to provide the Service or as required by law
• You can export your data at any time using the built-in export features

8. Organizations

Organization features allow teams to share a quota and manage members. The organization owner is responsible for member activity. Removing a member revokes their access but does not delete their historical data contributions.

9. Service Availability

We strive for high availability but do not guarantee 100% uptime. We are not liable for interruptions due to maintenance, third-party outages, or force majeure events. Scheduled maintenance will be communicated in advance when possible.

10. Intellectual Property

The Service, including its code, design, and branding, is the intellectual property of Genius Labs. The embeddable widget may display "Powered by Voice Capture" on the Free plan. Paid plans allow removal of this branding.

11. Limitation of Liability

To the maximum extent permitted by law, Genius Labs shall not be liable for any indirect, incidental, special, or consequential damages resulting from the use of or inability to use the Service. Our total liability shall not exceed the amount you paid in the 12 months preceding the claim.

12. Termination

• You may terminate your account at any time from Settings
• We may suspend or terminate accounts that violate these Terms
• Upon termination, your data will be retained for 30 days before permanent deletion

13. Changes to Terms

We may modify these Terms with 30 days' notice. Continued use after changes constitutes acceptance. Material changes will be communicated via email to registered users.

14. Governing Law

These Terms are governed by the laws of Colombia. Disputes shall be resolved in the courts of Bogota, Colombia, unless otherwise required by applicable consumer protection laws.
